Brussels rules are letting thousands of migrants into Britain ‘by the back door’.
Nearly 11,000 moved here this year on the basis of having been given citizenship in another EU country.

The total, revealed in figures from the Office for National Statistics, is up more than a third on the 8,000 cases recorded in 2006. Many of the migrants would normally have been barred from taking up residence in Britain.

But under EU rules they are automatically entitled to  come here once they have EU citizenship and start working – or claiming benefits. The data, compiled from passenger surveys, shows that 47,000 non-EU immigrants have found their way to the UK using this method over the past five years.

Priti Patel, the Tory MP who uncovered the information, said the loophole completely undermined Government efforts to curb the surge in immigration that took place under Labour. She urged ministers to raise the issue in Brussels and take action to wrest back control of Britain’s borders.

Miss Patel took up the issue herself after a BBC documentary in October highlighted the case of an Ecuadorean family who moved to London after gaining citizenship in Spain.

The family of six were receiving £2,300 a month in housing benefit to rent a flat in Islington, as well as tax credits and child benefit.


Miss Patel said she was ‘astonished’ by the number of people entering the UK by this route.

She added: ‘The Government has made a commitment to cut immigration from outside the EU into  Britain. But those efforts are being completely undermined by this astonishing loophole which has already allowed 10,000 non-Europeans to sneak in through the back-door each year.

‘The British public are living with the consequences of a decade of Labour’s open door policy on immigration which is why this Government must take on these EU laws that let non-Europeans come into Britain and access jobs and benefits.


‘It is in the British interest to reject these laws and on this issue, just say no to Europe.

‘This also raises the question of why these people are choosing to come here. They have entered the EU elsewhere and chosen to become citizens of other EU countries, yet they are still coming here.

‘Is it down to a benefits system which encourages people to come here and live off the state?’

The revelation raises fresh questions about the Coalition’s pledge to cut net immigration to under 100,000 a year. Last month official figures revealed that the figure had soared to a record 252,000 in 2010.

EU countries all have different requirements for migrants wanting to become a citizen, and there are fears that some could be a soft touch for those whose ultimate aim is to come to the UK.

EU rules mean that asylum seekers are meant to be dealt with in the country of their arrival. But in cases where a migrant or asylum seeker has been granted citizenship they are free to travel anywhere in the EU.

Critics claim that Britain’s generous benefits system acts as a magnet for migrants.

Ministers have introduced a range of measures designed to curb immigration, including a cap on the number of non-EU economic migrants coming here and a crackdown on bogus colleges providing a route into Britain for migrants posing as students.

But officials admit there is little they can do to curb immigration from the EU, because free movement of labour is a fundamental principle of the single market.

A landmark ruling by the European Court of Justice last week stripped Britain of its power to return asylum seekers to Greece.

Under EU rules, British officials can return asylum seekers to the first European country they set foot in.

But the ECJ last week said no one should be returned to a country if it did not uphold their ‘fundamental rights’. This would rule out Greece because its asylum system is in such a mess.

THOUSANDS of foreign students could find it easier to stay in Britain after a landmark decision backed their human rights to a new life here.

In the latest blow to the Government’s bid to reduce the scale of immigration, a judge decided that a cricket-playing migrant could stay because he had made friends and it would be distressing for him if he was sent home.


Politicians and campaigners last night said they fear the test case could open the floodgates to other foreign students hoping to settle in this country after finishing their courses. They claim the court
ruling, secured by 23-year-old trainee accountant Abdullah Munawar, could lead to a wave of similar appeals as the Home Office battles to limit the numbers settling in Britain.
Critics said the case highlighted the urgent need for reform of controversial human rights laws which are increasingly being used by foreign criminals and over-stayers to avoid deportation. The Bangladeshi student won his case because he argued that he had established a social life by playing cricket and making  friends.

The courts ruled that Mr Munawar, whose initial application was turned down by the Home Office, could continue to enjoy a “private life” in this country under Article 8 of the European Convention of Human Rights.
But critics accused the courts of undermining attempts to control Britain’s borders, arguing that almost every foreign student would be able to claim they have made friends.
Immigration Minister Damian Green said he was “disappointed” and was working to change the rules on immigration to end farcical decisions.
And Lord Tebbit, the former Tory minister who once proposed a “cricket test” to help identify whether immigrants had integrated into British life, described the case as “absurd”.

Mr Munawar, who came to Britain in 2008, told the Upper Tribunal of the Immigration and Asylum Chamber in London that he should be granted a new visa because he had partially completed his training and had a social life in Britain. Judge Susan Pitt said he had shown he played cricket at weekends, attended mosque regularly and had “formed friendships with fellow students and work colleagues”.
The judge ruled that the Home Office’s refusal of a visa “amounted to a disproportionate interference with private life that deserved respect”.
Normally, foreign students are granted visas of up to three years and are expected to leave the country once they are up. In the 12 months to June, 271,000 student visas were issued.Nigel Farage, the UK Independence Party leader, said: “Making friends, especially in a friendly country like Britain, is not exactly hard. The Human Rights Act just has to go and soon if we are to regain both our sanity and control over our borders.”
Mr Munawar, a fast bowler for Southgate Cricket Club in north London, said his playing of the sport in Britain helped to demonstrate that he was committed to life in this country.
“Cricket is our national sport in Bangladesh. I’ve been playing since I was 10 or 11,” said Mr Munawar, who lives in Limehouse, east London. “I haven’t really been following English cricket but now that I live in England I hope to get more familiar with it.”
He said he has applied for a work permit and intends to seek a job with a medium-sized accountancy firm. He is also hoping to wed in an arranged marriage after his imam suggested a potential partner last month.
Mr Munawar’s legal adviser, Tamij Uddin, said he believed the appeal would set an important precedent.
The case is the latest in a series of controversial decisions in recent months. They include the example of Lionel Hibbert, a 50-year-old Jamaican criminal who fathered three children by three mothers within four months and claimed he should not be deported because of his “right to family life”. Any bets the potential wife is from Bangladeshi, and a second cousin, bloody inbred foreigners!

The judge also needs testing for possibly being the result of inbreeding, I though the human rights were about maintaining a family life not claiming you have a bloody social life and friends.

British judges are PATHETIC......own a cat and you get to stay, play cricket and you get to stay.

Thge sooner someone shoots a few dozen immigrants the sooner these idiotic judges and MPs who are deliberately destroying our country wake up to the peoples wishes.

This got me thinking how the cancer that is Islam is being allowed to spread across Woden's country. This morning my wife watched Eastenders in which 'Pat',a fictitious person, died of cancer. She said it was so very sad as the plot had been built up over the weeks. Make no mistake, my wife is right behind me in our cause and fight but does this not speak of the 'shadow people' that run this country using crap TV like this to keep us asleep. Lets be honest, no matter how dire it gets in the real world it's always that much worse in the soaps.
By the way, I hear England has a couple of problems but isn't it soooooo sad about Pat bloody Butcher.

Lets get our own law keepers in place with th ancient and almost dead concept of common sense !!
